2daytrader.com (“we”, “us”, “our”, “2daytrader.com”) provides investment information via its website (“Site”, www.2daytrader.com), via email and in other formats. Any information or products or services you use from 2daytrader.com are subject to your compliance with the terms and conditions set forth in this Agreement. By using our information, you agree to be bound by these terms and conditions. This Agreement is made between 2daytrader.com and you, the user and/or member of the Site (“you”). We reserve the right at any time to: change the terms and conditions of this Agreement; change the Site, including eliminating or discontinuing any content or features on the Site; or change any fees for use of the Site, any related products or services.
Code of Conduct. While using the Site you agree NOT to:
- Copy, frame or mirror any 2daytrader.com information without our prior written authorization;
- Permit anyone else whose account or subscription was terminated, or who is not a 2daytrader.com paid or trial subscriber, to use the Site through your subscription, username or password;
- Engage in spamming, flooding or hacking;
- Transmit any materials that contain any computer virus, worm, or other harmful or disruptive element;
- Modify, adapt, sublicense, translate, sell, reverse engineer or disassemble any portion of the Site;
- Remove any copyright, trademark, or other proprietary rights notices contained in the Site.
Registration for Subscription/Membership Services. You must be 18 years of age or older to subscribe to any of our services. When you register to subscribe, you agree to (a) provide accurate information about yourself as prompted by the appropriate registration form, and (b) to maintain and update your information to keep it accurate, current, and complete.
You agree not to transfer or resell your use of or access to any information from 2daytrader.com to any third party. If you are a 2daytrader.com subscriber, and you have reason to believe that your online account is no longer secure, you must promptly change your password by updating your account information and/or immediately notify us by emailing us at: [email protected].
Some of our subscription services involve email or text as delivery methods. We assume no responsibility or liability for undelivered or late emails or text messages whatever the reason may be. If you have problems getting your products delivered, contact our Support Team at [email protected]. We will make every effort to assist you with potential solutions that may fix delivery issues.
Payment and Renewal. Current subscriptions are available on 2daytrader.com’s product pages. Payment for your subscription is due in advance of the subscription period you select. 2daytrader.com does not automatically renew services unless you specifically subscribe to an automated renewal program for your convenience (see Automated Renewal Programs below.) The appropriate annual, quarterly, monthly, or similar periodic fee for your subscription will be billed at the beginning of your subscription period to the payment method you designate unless you notify 2daytrader.com in writing, according to our Cancellation Policy below, that you do not agree to the Terms of this Agreement within 72 hours from the time of your receipt of this Agreement or its current URL location (i.e. upon registration on the site.)
Automated Renewal Programs. The following pertains only to automatically renewing services. Periods (and periodic fees) are those reflected in the 2 Day Trader part number and/or description of the service you purchase (the most common are one-, three- and twelve-month periods) as found on every itemized receipt. By participating in an automated renewal program, you are expressly agreeing that we are authorized to charge you a periodic fee at the then current rate, and any other charges you may incur in connection with your use of the applicable 2 Day Trader service(s) to the payment method you provided during registration (or to a different payment method if you change your account information.) Please note that prices and charges are subject to change. The appropriate annual, quarterly, monthly, or similar periodic fee for your subscription will be billed automatically at the beginning of your subscription period to the payment method you designate unless you notify 2daytrader.com in writing PRIOR to the billing date for the upcoming period. Monthly and annually renewing subscriptions renew on the same day each month/year; quarterly subscriptions renew each 90 days.
It is your responsibility to provide current and accurate payment method information. If you wish to change your payment method or if there is a change in your payment method information (i.e. credit card verification code or expiration date) you may notify us via email to [email protected]. If your payment method reaches its expiration date and you do not edit your payment method information or cancel your account, you authorize us to continue billing that payment method and you remain responsible for any uncollected amounts. We do not provide refunds for any month-to-month charges made under the automated renewal program. Longer term automated renewal programs are subject to our pro-rata Refund Policy below.
Cancellation Policy. You may cancel your subscription to any 2daytrader.com service, at any time, by notifying our Accounting Department IN WRITING. Cancellations may be emailed to [email protected]. Cancellation will take effect no later than 3 business days after we receive your notification.
Refund Policy. Monthly subscriptions will not be reimbursed or refunded. If services longer than one month in duration are purchased, a pro-rata refund will be offered based on the number of months used. The full list price for each month, or portion thereof, used will be deducted from total amount paid for the cancelled service. Any pro-rata refunds will be made by Company check which will be mailed out within 2-4 weeks from our receipt of written cancellation.

Coaching – One month Coaching programs will not be reimbursed or refunded.
For Coaching programs longer than one month in duration, a full refund (less 5% processing fee and list price for associated hard goods and/or on-demand products delivered) may be obtained only if we receive your written cancellation PRIOR to the second session in the program – send your cancellation request to [email protected].

Termination. This Agreement shall remain effective until terminated in accordance with its terms. 2daytrader.com may terminate this Agreement, and/or your access to and use of the Site or any portion thereof, immediately, in the event we determine, at our sole discretion, that you have breached this Agreement. In addition, we reserve the right, upon 10 business days’ notice and the reimbursement of any monies due according to the Cancellation and Refund Policies above, to terminate this Agreement without cause.
Ownership and Restrictions on Use. ©2022 2daytrader.com. All Rights Reserved. The Site is owned and operated by us in conjunction with others pursuant to contractual arrangements. You may only access and use the materials on the Site, and download and/or print out only one copy of any materials on the Site, solely for your personal use. You may not republish, upload, post, transmit or distribute materials from 2daytrader.com in any way without our prior written permission. Modification of the materials or use of the materials for any other purpose is a violation of our copyright and other proprietary rights, and is strictly prohibited. You acknowledge that you do not acquire any ownership rights by using information from 2daytrader.com. “2daytrader.com” and the 2daytrader.com logo are trademarks and/or service marks of 2daytrader.com. All other trademarks, service marks, and logos used on the Site are the trademarks, service marks, or logos of their respective owners.
Links to Other Websites. The Site may contain links to other Internet websites or resources. We neither control nor endorse such other websites, nor have we approved any content that appears on such other websites. You acknowledge and agree that we shall not be held responsible for the legality, accuracy, or inappropriate nature of any content, advertising, products, services, or information located on or through any other websites, nor for any loss or damages caused or alleged to have been caused by the use of or reliance on any such content.
DISCLAIMERS. UNDER NO CIRCUMSTANCE ARE 2DAYTRADER.COM, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES OR AGENTS LIABLE FOR ANY INCIDENTIAL, CONSEQUENTIAL, PUNITIVE OR SPECIAL DAMAGES OF ANY NATURE WHATSOEVER ARISING OUT OF OR IN CONNECTION WITH PROVIDING OR FAILING TO PROVIDE SERVICE, INCLUDING, WITHOUT LIMITATION, LOST PROFITS OR LOSS OF BUSINESS. THIS SECTION SHALL ALSO SURVIVE THE TERMINATION OF THIS AGREEMENT. Your sole remedy for dissatisfaction with the Site and/or content contained within the Site is to stop using the Site or other information from 2daytrader.com. The sole and exclusive maximum liability to the company for all damages, losses, and causes of action (whether in contract, tort (including, without limitation, negligence), or otherwise) shall be the total amount paid by you, if any, to access the Site or its contents.
Indemnification. You agree to indemnify, defend and hold us, our officers, directors, employees, agents and representatives harmless from and against any and all claims, damages, losses, costs (including reasonable attorneys’ fees), or other expenses that arise directly or indirectly out of or from (a) your breach of this Agreement, including any violation of the Code of Conduct above; or (b) your activities in connection with the Site or any services related to the Site. This indemnification extends to and includes any attorney’s fees and costs incurred by us arising from any action or claims to which this indemnification applies, or from the contesting of the applicability of this provision. This section survives termination of this Agreement.
THIS AGREEMENT IS GOVERNED BY AND MUST BE CONSTRUED UNDER THE LAWS OF THE STATE OF KENTUCKY, WITHOUT REGARD TO CHOICE OF LAW PRINCIPLES. YOU AGREE TO SUBMIT YOURSELF TO THE PERSONAL JURISDICTION OF THE COURTS IN THE STATE OF KENTUCKY.
General Terms. If any part of this Agreement is held invalid or unenforceable, that part is interpreted consistent with applicable laws as nearly as possible to reflect the original intentions of the parties and the rest of this Agreement remains in full force and effect. 2daytrader.com and its officers and employees are not registered investment advisors or broker/dealers. We are purely a research organization, seeking to provide unbiased information for educational purposes only. Readers are advised that the commentary and reports on its website(s) and in its newsletters are issued solely for information purposes and should not to be construed as an offer to sell or the solicitation of an offer to buy any security.
